Yoomba's Privacy Policy
Thank you for visiting www.yoomba.com (together with all other websites operated by Yoomba Ltd., the ?Site?). Your privacy is important to us. Introduction
We are committed to respecting your online privacy and recognize your need for appropriate protection and management of any personally identifiable information ("Personal Information") you share with us. In order to provide you with the services given under the Yoomba product/s and/or Site, you provide us with your email address that will be used by us as your User ID. We will send to such email address the software and/or link that you wish that will allow you to activate/download from our Site.
Uses
When you use any of the Yoomba's services and/or software you provide three types of information: (1) Personal Information you actively choose to disclose to the Yoomba (Active Information), (2) Usage Information that is provided passively or generated automatically during your use of software (Passive Information) and (3) information that you share or communicate with other software users (User Information).
Active information includes information which is required in order for the software to verify your identity and provide you with the Yoomba's services. This includes your Yoomba User ID and password. Active information may also include any billing information you submit, but only if you should purchase services from Yoomba.
If you choose to invite a friend to join Yoomba through use of the software or facilities available at the Site and related pages, you will be either doing so by using one of the buttons next to "contact names" and/or "email addresses" in the application, via a web page with the possibility of adding one or more email addresses in an online form, or via group invitation approved by the user, by clicking on a button to proceed. Yoomba does not invite users without showing the user the list of "contact names" and/or "email addresses" that will be invited, and requires a user to click on a button to invite or proceed. Any information next to a button, in a group invite list, or entered in a form is used to send the content to those specified email addresses. Additional terms and policies may apply for sending invitations. The Site and/or software may also contain feedback forms to provide feedback directly to Yoomba employees. Any and all information which is voluntarily submitted in such feedback forms are used for the purposes of improving the software and services. Yoomba reserves the right to utilize this information for marketing purposes, for instance by displaying selected comments on its Site or in other communications.
From time to time, Yoomba may send you surveys or solicit your feedback. Yoomba uses surveys to gauge user interest in new products and premium services it may offer. Yoomba will ask for your feedback on Site features. Yoomba will use the information it gathers to improve its sites and provide a more meaningful experience for its users. Yoomba may also use the information to alert you to offers and products of Yoomba in which you have expressed an interest.
User Information may be required by certain Yoomba services in order for the software provided on the Site to function as intended and, if so desired, for other users of the software to communicate with you. User Information includes any information you enter in your User Profile (such as name and email address) and also includes your current online status and your IP number.
Passive Information is limited to information that is necessary in order to provide you with the desired functionality of the software and may includes a session ID token, source and destination addressing information, destination you are communicating with, variables of communication activity, usage within the Yoomba application, the version of the software you are using, and code from the Yoomba software. Passive Information is automatically generated for quality assurance purposes, and to provide you with better service or statistical information used for the purposes of detecting fraud or to block access to Yoomba services according to the terms set out in the applicable End User License Agreement
Cookies
Yoomba may use cookies to assist in delivering the service and to provide a positive and personalized user experience. Cookies are files sent to your browser from a web server and stored on your computer's hard drive.
Notice
We do not provide your Personal Information to third parties, except for third parties who may perform services on the Site or for you. We may choose to make certain offers or services available to our users from third parties. Neither Yoomba nor its officers or employees may be held liable for any claim, damage, or loss, and You hereby waive, to the maximum extent permitted by applicable law, any and all such claims or causes of action, arising from or relating to the use of VoIP service or any other service provided hereunder to contact Emergency Services personnel. You shall defend, indemnify, and hold harmless Yoomba, Yoomba staff, affiliates and agents and any other service provider who furnishes any services to You in connection with the VoIP service or any other services provided under these Terms of Service, from any and all claims, losses, damages, fines, penalties, costs and expenses (including, without limitation, attorneys fees) by, or on behalf of, You relating to the absence, failure or outage of the VoIP service or any other service provided hereunder, including specifically any claims arising out of the failure of Yoomba to offer Emergency Services. Alternative Arrangements. By agreeing to these Terms of Service You acknowledge and accept that Yoomba does not offer Emergency Services. You understand that additional arrangements must be made to access Emergency Services. To access Emergency Services, You acknowledge and accept Your responsibility to purchase, separately from VoIP service, traditional wireless or wireline telephone service that offers access to Emergency Services. No Compulsion to Offer Emergency Services. You recognize and agree that Yoomba is not required to offer Emergency Services pursuant to any applicable local and or national rules, regulation or law. You further recognize that Yoomba is not a replacement for Your primary telephone service. No emergency calls. You expressly acknowledge and agree that the VoIP service provided by Yoomba does not and is not intended to support or carry emergency calls to any type of hospitals, law enforcement agencies, medical care unit or any type of emergency services of any kind and that Yoomba is not liable in any manner for such calls. In the event that, with Your permission, another user uses Your account, You are responsible to inform that user that it is not possible to support or carry emergency calls with the Yoomba VoIP service.
5. Local Laws; Export Control
You acknowledge that the Materials provided on this Site may be subject to export control laws. You agree to comply with all such laws.
6. Term and Termination
These Terms of Use, the license for use of the Site and the Materials is effective until terminated. Subject to the provisions set forth in this section, You may terminate it at any time by destroying the Materials together with all copies thereof. Unauthorized copying of the Materials or otherwise failing to comply with these Terms of Use will result in automatic immediate termination of Your right to access the Site and use the Materials and will make available to Yoomba other legal remedies. In such event, no notice shall be required by Yoomba to effect such termination.
