PRIVACY STATEMENT


Marketscore provides members with Internet-related services in exchange for the insights and knowledge our members provide regarding their Internet use. We have prepared this Privacy Statement in the form of a series of questions and answers that address our privacy and data security practices. If you have any questions regarding this policy or its application, please contact us as instructed below and we will try to address your question.


Who is Marketscore?


Marketscore is an Internet customer knowledge company which operates the Marketscore service and whose goal is to understand and help others understand Internet trends and patterns and to identify emerging economic trends. Just as television uses the rating services to determine which are the most watched programs and to influence the shows and commercials we watch, the Internet community relies on members of the Marketscore Network (or "Members") to understand the likes and dislikes of Internet users and to discern any patterns that may impact the success or viability of e-commerce and other business enterprises. As a knowledge provider, our goal is to understand your browsing and buying habits, but not to influence them. For this reason, we do not advertise on our site nor do we release your name or other contact information to third parties for direct marketing purposes. Marketscore (originally called Netsetter) is a service of comScore Networks, Inc. (www.comscore.com) and assists comScore Networks in providing information on Internet trends and usage activity.


What information is collected?


During the initial registration process, we request certain information, such as name, address, e-mail address, and education, about you and other persons who live with you or have the same mailing address as you (collectively, we call this your "Household"). After you register, our network then collects additional information about your Household's Internet behavior, and that of any other computers used by members of your Household that you have configured to use the Marketscore Network and service. We collect certain basic hardware, software and computer configuration information about the computer that is connected to our service including such data as the speed of the computer processor, its memory capacities, and Internet connection speed. The above information is then used to create an understanding of Internet e-commerce and general Internet usage trends. Marketscore also monitors your surfing, by routing your Internet activities through our service and logging information about the web pages that you visit and the actions that you take, such as the purchases and transactions you make, the pace and style with which you enter information online and request web pages, including whether you click on links, type in webpage names, or use shortcut keys. Marketscore can only monitor the Internet behavior and activity of your Household's registered and configured computers. As a Member, you therefore control which computers the Marketscore service is available on. Marketscore monitors all of your Internet behavior, including both the normal web browsing you perform, and also the activity you may have through secure sessions, such as when filling a shopping basket or filling out an application form that may contain personal financial and health information. Marketscore's proprietary and patent pending technology allows us to see the details of secure pages while protecting such content from parties other than the site to which you are connected. We monitor the Internet connections of our users so we can not only accurately and anonymously model the browsing habits of Internet users, but also their shopping, registration, and other interactions as well. Although we generally monitor your Internet behavior as part of this service, Marketscore does not analyze the content of or keep any instant messages you send nor do we analyze or use the contents of any of your e-mail messages, except to perform specific functions necessary to provide you the Marketscore service (such as scanning your e-mails to effectively search for viruses), and as a quality assurance check against and method for verifying your contact information and information on the surfing and buying behavior of Marketscore members.


How is the information collected?


When you register to be part of the Marketscore Network, we ask you for certain basic demographic information about you and your Household so we can better understand your Internet behavior, which we monitor through our patent pending technology. In addition to the monitoring of your Internet behavior, we may also combine the information that you provide us with information such as credit or prescription information that we obtain from third parties such as consumer preference reporting companies, credit reporting agencies, and prescription benefits managers. When we do combine the information that you provide us with information about you from third parties, we would undertake that process using secure and confidential matching procedures. As part of these procedures, we would provide only the personal information necessary to perform a match and, at the same time, restrict the third party's use of the information we provide to undertaking a match with Marketscore and, on a limited and infrequent basis, assisting us in statistically reporting and making projections about current and future Internet usage and online commerce. After this process is completed, the third party must destroy all records we made available. Please note that in all cases, Marketscore does not share or sell your name or the personal information that we receive from you for direct marketing purposes. Moreover, unless specifically authorized by you, we do not provide our commercial customers with any personally identifiable information about Marketscore participants.

To allow us to confidentially monitor your Internet activity, the registration process includes a step that configures your Internet browser and computer so that your Household's Internet communications are routed through our high-performance network. This routing is only done on the machines you actually configure for the Marketscore Network and we require you to take steps to ensure that members of your Household know and understand that our service is present on a given computer. In addition, from time to time, we may ask you to participate in Marketscore member surveys, which may be sent to you via e-mail or by other methods. Your participation in these surveys is optional and is not a condition of your Marketscore Network membership. For information about opting out of survey notifications, please see the below answer to "What if I wish to start or stop receiving emails from Marketscore?"


How is the collected information used?


Just as television-rating services monitor the viewing habits of a selected number of TV viewers to make projections as to what the entire TV viewing audience is watching, Marketscore applies similar concepts to the Internet. Marketscore uses the Internet activity and demographic information of our members to statistically report and make projections about current and future Internet user behavior and, more generally, to extrapolate data about potential economic trends. Marketscore essentially enables companies to tap the pulse of Internet users' preferences and provides a voice for Internet users to impact the future of Internet usage and e-commerce activities. When we provide predictive reports and projections about economic trends to our customers or use such reports internally, the analysis is performed on aggregated or bundled information. We do not provide our commercial customers with any personally identifiable information about Marketscore Members unless specifically authorized by you. In fact, our customers benefit from the aggregation or grouping of information because this type of data can be refined to more accurately reflect and predict trends, developments and Internet users’ behavior.

For certain commercial customers, we may provide anonymized individual-level information. We make this data available so that these customers may enhance their own understanding of Internet usage and online commerce. In making such information available, we do not provide these customers with personally identifiable information such as names, addresses, and email addresses.

Our customers use the information received to (i) modify online services and offerings; (ii) make more effective use of online data to understand both online and offline commercial behavior; and (iii) discern general economic trends and the business performance of specific entities for a wide range of business purposes including, but not limited to, identifying financial investment opportunities and understanding the value and interest in certain business enterprises. Our customers are able to make more informed decisions about their Internet and general business based upon understanding behavioral trends, buying patterns or other aspects of Internet usage and electronic commerce behavior.

There are some limited cases in which we share personally identifiable information with third parties. Specifically, we provide personally identifiable information to third parties for the purpose of conducting the secure and confidential matches discussed more fully above.

We also share your contact information with those third parties who help us deliver the Marketscore service to you. These parties are required to only use the information we provide for this limited purpose. This includes companies that from time to time service and administer Marketscore incentive programs (for example, we simply have to give them your name and address to award you a prize) and individuals that you refer to us as part of the refer-a-friend program. When we do provide your contact information to these service providers, we establish strict controls and enforce those controls through legal agreements that restrict the use of your member information to the functions necessary for us to deliver our service to you. In sum, our service companies may only use the information we provide to benefit you, the Marketscore member and to serve Marketscore. They are strictly prohibited from making any other use of the information and may not release it to anyone else, unless you authorize it.

On an internal basis, and as part of our operation and administration of the Marketscore Network, we may also use the contact information you provide for member verification, and for such tasks as sending e-mails to Members, and reporting to you membership incentives and changes and requesting updated information from you.

In rare cases, and as is done by any other company or business, we would disclose certain information if we are compelled to do so to comply with a valid legal process, such as a court order, subpoena, or a search warrant. In all cases, we would only comply with such orders by providing the minimum information necessary, while otherwise preserving Member privacy and data.


Are cookies used?


Yes, Marketscore uses "cookies" (which are explained below), but we use them primarily to maintain the effective operation of our Network. We do not use our cookies to store or acquire data about you, as that is the basic function of the Marketscore Network itself. The unique identification we make to your browser is not done via a cookie but rather by inserting a unique number into your browser so we can learn about your Internet browsing and surfing. To explain, a cookie is the name for a small piece of data that is set (in the form of a file) by an Internet computer server and is placed in your computer browser. Our site uses cookies to identify you as you go through our registration process, and to assist us in conducting occasional diagnostic tests to ensure that our service is functioning correctly. Our cookie does not contain any personally identifiable information about you. Since this is a cookie created by Marketscore, no one but Marketscore will be able to read it. Please note that if you configure your browser not to accept cookies, you may not be able to complete the registration process and enjoy the services and benefits of being a Marketscore Network Member.


How is the information secured?


Data security and the protection of personal information are essential to the success and acceptance of Marketscore. We recognize that if we fail to safeguard the information and knowledge our Marketscore Members help us create, we will not be able to offer the services we do. Accordingly, we have implemented a variety of data and information security safeguards focused on ensuring that Marketscore data and information are protected from unauthorized use, modification, or disclosure. Our employees are subjected to periodic evaluation and investigation, are contractually restricted on their use and access to personally identifiable information, and are educated and retrained as needed on internal security policies and procedures.

Recognizing that trust in the Internet age is difficult to earn, we have taken significant additional steps to ensure that not only are we doing all we can, but we allow third parties to come in and periodically challenge and test our data security and information handling practices to ensure we are achieving our goal of vigorously protecting Marketscore Member data. Since late 2000, we have been one of a handful of companies to earn the honor of achieving and retaining what was initially called Cyber Process Certification and is now called a Webtrust/Cyber Certification issued by Ernst & Young, LLP, a global accounting and auditing firm. The certification entails an analysis of Marketscore's privacy and data security practices including our data acquisition, processing and reporting procedures. The examination and testing include attempts to break into and compromise the hardware and security systems we have built. The certification also involves detailed verification and confirmation by our auditors that we only observe the information we declare we collect and we only use that information as we have disclosed and agreed with you, our Marketscore member. Our achievement of this certification and our ongoing efforts to monitor and improve data security will ensure that the information entrusted to us remains confidential and used only as we have agreed with our members.


How does Marketscore scan my email for viruses?


The viral scanning of your email is achieved by routing your messages to one of our Marketscore computer servers. Once the email has been sent to our server, Marketscore scans your email using Symantec Corporation’s virus checking software. This software automatically, and without any human examination of the email contents or recipient information, analyzes it to ensure that the email does not contain known viruses or malicious elements. Email viruses and other harmful downloads are identified by Symantec’s software using automated pattern recognition techniques that compare the contents of an email with the known characteristics of viruses and harmful computer programs. If the match between the data pattern in an email and that of a known virus is identical or highly similar, the Symantec software will identify the message and quarantine it so it can be safely disposed. In all cases, Marketscore does not seek to learn of and does not know the contents of your email message or its recipient(s). In addition, we do not keep copies of the email that is scanned by the Symantec software, except we do record the number of emails scanned using the Symantec software.


Does Marketscore monitor my instant messaging and use of other computer applications?


Marketscore collects aggregate statistics about your use of online applications (an online application is any computer application that, as part of its operation, communicates with another computer via the Internet). For example, Marketscore could record that during a given period of use of a computer, the computer downloaded X number of bytes of data using, for example, a particular Internet enabled gaming application. In all cases, the Marketscore service does not track or record your use of any intranet applications. In addition to the statistics we collect, we will also monitor Internet data transmissions for specific data patterns of interest to Marketscore. An example of this would be monitoring for an instant message being sent. Marketscore detects when an instant message is sent by identifying the specific data pattern associated with messages sent by selected (but not all) IM applications. In addition, we also collect summary statistics on the amount of data sent and received by these online applications. This type of monitoring only occurs when you are configured for, and are using, the Marketscore service and are connected to the Internet. We collect and use this information so we can assess the popularity of certain online applications.


How can I change my profile and/or preferences?


You can review and modify the demographic and member profile information that you entered during registration by going to the Members Area at www.marketscore.com/login.aspx. Also, we may occasionally send you an e-mail requesting you to update your demographic information to keep your membership information current.


What if I wish to stop or start receiving emails from Marketscore?


Marketscore may occasionally send administrative emails to members to inform them about required upgrades, disruptions to our service, or issues related to basic Marketscore functions; to provide notification to prize winners; and/or to request updated demographic information. Additionally, depending upon the choices you made upon registering for the service, we may occasionally contact you to advise of special member opportunities, or to invite you to participate in surveys or research that we believe matches your interests and preferences. If you ever wish to stop receiving any of these optional communications about special member opportunities or online surveys, you can go to the secure Members Area of our website at www.marketscore.com/login.aspx and follow the instructions explaining how to remove yourself from our lists. Additionally, in these optional communications we include an option allowing you to email Marketscore to indicate that you no longer wish to receive such communications.


What if I wish to resign my membership?


If you wish to resign your membership, just go to the Members Area of our website at www.marketscore.com/login.aspx and follow the instructions explaining how to resign your membership. Or you may remove Marketscore from your computer by going to Add/Remove Programs in the Control Panel section of your computer, selecting Marketscore, and clicking the Remove button. If you signed up for Marketscore on more than one computer and no longer want the service on any of these computers, please be sure to follow this same Marketscore resignation procedure on all of the computers on which you registered for Marketscore. When you resign, we will cease monitoring your Internet activity as part of unconfiguring your computer, which reverses the Marketscore modifications. All information collected prior to resignation may continue to be used by Marketscore, and all such remains fully subject to, and governed by, your original Membership Agreement. Please note that use of third party programs to remove the Marketscore service may cause instability in your system and to your Internet connection. Marketscore reserves the right to repair any of its settings that are partially removed, to minimize potential instability. Should you wish to resign, we ask that you use the instructions provided by Marketscore to remove our service.


What happens to my computer when I resign?


When you resign from our service, either by resigning at our website or by using a removal utility we provide, we immediately cease all monitoring of your Internet use and we no longer route your Internet traffic across our network. As part of the deconfiguration process, all settings we have made to your computer are deactivated; however, some inactive elements may remain on your machine such as registry entries or DLL files, which is not at all unusual for many types of online services and software. We are working on future versions of our service that will address this issue; please revisit this site for information on that effort.


What is the policy regarding children?


The protection of children and ensuring that only informed Internet users agree to use the Marketscore Network is essential. Our Marketscore Membership Agreement requires that all persons registering for the Marketscore Network be at least 18 years old. If your Household has children under the age of 18, only the parent or legal guardian may register. However, all household Internet behavior may be used in developing the statistical reports for our service. Marketscore complies with all applicable U.S. data gathering rules, including the Children's Online Privacy Protection Act (COPPA).


How will I be notified of changes to this privacy statement?


If we change our practices in how we handle personally identifiable information, or if we materially change other aspects of our service, we will notify you by posting proposed changes to this Privacy Statement and on our web site. The changes will be effective immediately upon such posting. If you do not agree with any of the changes, you may cancel your membership as described above.


Is all my Registration information required?


To create the most accurate picture of our members' Internet activity, it's important that we get the most accurate descriptions of our members in their profiles: who they are and the demographics that describe them. (For certain demographic information we request, you have the option of replying, "Rather not say.") We ask that this information be entered during the registration process because, without it, we cannot accurately project Internet behavior as a whole. We also ask that you make a conscientious effort to return to the members' site and update your demographic information if it changes or if you did not enter it during the registration process. Your effort will help us produce more accurate information.
