It may also be processed by our staff in the UK, by employees who operate outside the EEA who work for us or by those who provide support services to us. Such employees maybe engaged in, among other things, the processing of your membership details and the processing of your payment details. By submitting your personal data, you agree to this transfer, storing or processing. We will take all steps reasonably necessary to ensure that your data is treated securely and in accordance with this privacy policy.

We may disclose your personal information to any member of the Mainstream group of companies, which means Mainstream and its subsidiaries, as defined in section 736 of the UK Companies Act 1985.

* In the event that we sell or buy any business or assets, in which case we may disclose your personal data to the prospective seller or buyer of such business or assets.

How We Collect and Use Information

Joining
When you join a Site as an individual, we will ask you to create a screen name and password, and to provide your e-mail address, postal code and date of birth. When you join a Site as a business, you will be asked to create a business name and password, to provide an e-mail address, postal code and the industry of the business, and to confirm that you are over 18 years of age.

Building a Profile
After you have joined a Site, we will ask you to build one or more profiles about yourself or your business on the Site, or to buy services from MOLI. We may ask you in this regard to provide information about yourself or your business, including your name, age, personal interests, gender, education, job, company or organization name, e-mail, phone, home address, information about your company, and credit card information. If you wish, you may provide some or all of the information requested, and/or additional information about yourself or the business ("Voluntary Data"), to allow other users and visitors to get to know you better and possibly encourage them to choose you as a friend or an appropriate business contact on the Site. The Voluntary Data you choose to provide may be accessible to all other users and visitors to the Site, unless you elect to make the data private or for restricted viewing only. With regard to such particularly identified data, you may determine in each case if the data shall be displayed in public, or be kept private or be completely hidden except for viewing by persons and/or businesses you specifically allow to view the data.

When you become a registered user on the Site, you must have at least one profile that is public ??? i.e. that can be viewed by other users or visitors to the Site. For any other profile that you build (???Subsequent Profile???), you can set the level of your permissions that govern privacy on that profile at any time. This means that you decide whether to increase your level of privacy or to opt in favor of more visibility online, enabling more exposure of your Subsequent Profile for potential friends and/or business partners. When you first open your control panel to build a Subsequent Profile, the default privacy setting is set to ???public???, to promote the spirit of networking. You may change this setting when you build that profile and/or at any time you are a member of the Site. The data contained in your public profiles are visible to members and non-members of the Sites and traceable by search engines on the Internet. This, however, does not include personal contact details that you provided when you joined the Site, such as your email address, unless you have also posted that information in a public profile.

You also have the ability to control the use of certain tools you add to your profiles or media that you post there. For example, you may limit or exclude comments on your blogs. You may place ratings on media that you post to your media albums, which would limit the ability of visitors who are not registered on the Site to view the media. You may also restrict the ability of users or visitors to ???grab??? or share the media you post to your media album.

Some of the information you provide when you join a Site may personally identify you (personally identifiable information) to us or allow us to contact you to provide a service, to carry out a transaction that you have requested such as receiving information about our services and products, to authenticate users and to help users to network with other users.

We use both your personally identifiable information and certain non-personally-identifiable information (such as anonymous user usage data, cookies, IP addresses, browser type, clickstream data, etc.). Our primary goal in collecting profile information is to provide you with the best and most useful content and services, to improve the quality and design of our Sites, to create new features, promotions, functionality, and services by storing, tracking, and analyzing user preferences and trends and to offer you opportunities to obtain other services and products from us and our partners. We collect such information when you provide it to us when you register on our Sites, or register to use certain services. Non-personally-identifiable information may be shared with third-parties to provide more relevant services and advertisements to members. User IP addresses are recorded for security, maintenance and monitoring purposes.

Any personal information or content that you voluntarily disclose online (on discussion boards, in messages and chat areas, within your public profile page, etc.) becomes publicly available and can be collected and used by others. Your account name (not your email address) is displayed to other users when you upload videos or send messages through our Sites, and other users can contact you through messages and comments. Unless you restrict the use of media that you post to your media album, any videos or images that you submit to the Sites may be redistributed through the internet and other media channels, and any video or images in your public profile may be viewed by the general public.

We advise that you should be cautious about posting a real e-mail address or other personal information on your profiles or to newsgroups, chats, or other public forums.

It is your responsibility to maintain the confidentiality of your password and account information.

We offer various possibilities to search for particular MOLI customers and users. These search functions may assist you, for example, in finding other MOLI users with similar interests. The search functions can also help you to initiate contact with other MOLI users who offer exactly what you are looking for. Thus, you can find the contacts you need - and systematically expand your personal or business network. In the same way, other users of the Sites or visitors may be able to search for you and thereby find any personal information you have posted on a public profile on a Site. Search engines may index the portion of a user???s profile (including the information it contains) that is publicly displayed.

We may also use a user's email address to send updates, a newsletter or news regarding our services. Users may choose not to receive email of this type by changing their "notification" setting to "Do not send me notification emails" in the user "Account Settings". Our Sites may also use your email address without further consent for non-marketing and administrative purposes. Any MOLI member may send you messages on the Site. You do, however, have the ability in the ???Manage Your Friends??? section of your ???Control Panel??? to block messages from a user that you have accepted previously as a friend or business contact.

From time to time, MOLI or a partner may sponsor a promotion, sweepstake or contest on our Sites. Users may be asked to provide personal information including name, email address or home address or to answer questions in order to participate. We may transfer personal information to certain advertising partners that you have explicitly requested to receive information from. It will be clear at the point of collection who is collecting the personal information and whose privacy statement will apply.

Note for Users Who Refer a Friend
If you choose to use our referral service to tell a friend about our Sites we will ask you for your friend???s name and email address. We will automatically send your friend a one-time email inviting him or her to visit our Sites. MOLI stores this information for the sole purpose of sending this one-time email and tracking the success of our referral program.

Your friend may contact us at privacy@moli.com to request that we remove this information from our database.

Sharing Information With Other Companies or People
We do not sell, rent, trade, or lease your personally identifiable information for marketing purposes, without your consent or except as part of a program or feature for which you can opt-out. We will use your personally identifiable information for our own internal marketing purposes. If you do not wish us to use your personal information for our marketing purposes you can opt-out by following the instructions under "Choice/Opt-out" below. We do share non-personally-identifiable information with interested third-parties to assist them in understanding the usage patterns for certain content, services, advertisements, promotions, and/or functionality on the our Sites. If you join MOLI by registering through one of our co-brand partners, we may provide that partner with the e-mail address you provide when you register.

Except as otherwise described in this policy, we will not disclose personally identifiable information and non-personally identifiable information to any third party unless we believe that disclosure is necessary: (1) to conform to legal requirements or to respond to a subpoena, search warrant or other legal process received by us, whether or not a response is required by applicable law; (2) to enforce the our Terms of Service or to protect our rights; or (3) to protect the safety of members of the public and users of the service. We reserve the right to transfer personally identifiable information to a successor in interest that acquires rights to that information as a result of the sale of MOLI or substantially all of its assets to that successor in interest. For more information see the "Notification of Changes to Privacy Policy" section below.

We may, however, share your personally identifiable information and non-personally identifiable information with certain sites that control us, are controlled by us, or under common control with us (our "Affiliates"), and sites operated by our Affiliates or other businesses of the Mainstream Holdings, Inc. our parent company, so that they and we can offer you services and products that may be of interest to you and to process such information on our behalf.

Logged Files, Cookies and Web Beacons

For systems administration and payment fraud control purposes, when you use our Sites, our servers will log information such as Internet Protocol ("IP") address, your web request, browser type, browser language, referring / exit pages and URLs, platform type, number of clicks, domain names, landing pages, pages viewed and the order of those pages, the amount of time spent on particular pages, the date and time of your request, and one or more cookies that may uniquely identify your browser. These logs are analyzed to deal with payment fraud and improve the value of the materials available on the Site. User's sessions are tracked, but the user remains anonymous. We link IP addresses to personally identifiable information to process your payments only. In addition, we use your service provider's Internet Protocol ("IP") address to help diagnose problems with our server, administer our Sites, and gather broad demographic information.

Our Sites also use cookies. A cookie is a small text file that is stored on a user's computer for record-keeping purposes.

We use both session ID cookies and persistent cookies. We use session cookies to make it easier for you to navigate our Sites. A session ID cookie expires when you close your browser. A persistent cookie remains on your hard drive for an extended period of time. You can remove persistent cookies by following directions provided in your Internet browser's "help" file.

We use cookies to identify you during your session, to make services easier to use and to store items in your shopping cart between visits. Cookie technology allows our advertisers or us to recognize you as a return visitor. For example, based on a cookie, our Sites would know that you are interested in certain information and could take the opportunity to let you know of new services being offered. Our Sites use cookies to keep track of your preferences and to make sure you do not see the same information repeatedly. Cookies are never used to store sensitive customer information such as names, addresses, credit card numbers or passwords.

Acceptance of cookies is not a requirement to browse our Sites. Most browsers automatically accept cookies, but you can configure your browser to prevent that. However, if you choose not to accept cookies from our Sites, it may affect the scope of the services available from our Sites.

We may display banners, links, and ads on our Sites. These items may contain cookies.

We may allow other companies, called ad networks, to serve advertisements to the users of our Sites. Ad networks include third party ad servers, ad agencies, ad technology vendors, and research firms. MOLI and/or its Affiliates may "target" some ads to users that fit a certain general profile, for example, "product managers in Florida."

To deliver these ads properly, MOLI and/or its Affiliates may include a file, called a web "beacon" or a "clear GIF", from these ad networks within pages served by MOLI and/or its Affiliates so the networks may provide anonymized (without using personally identifiable information), aggregated auditing, research, and reporting for advertisers as well as to target ads to you while you visit other websites. Web beacons are used to track our users anonymously and to determine which emails we send to our users are opened by the recipients.

Because your web browser must request these advertisements and web beacons from the ad network's servers, these companies can view, edit, or set their own cookies, just as if you had requested a web page from their site.

These general targets may also be used by ad networks to display targeted ads on other websites as a substitute for random, irrelevant ads.

You may opt-out of use of web beacons in the pages of our Sites that you view and of placement of a cookie by ad networks in your browser. If you opt-out you will lose the potential benefit of receiving ads that are more targeted to your interests.

Third Party Service Providers

We sometimes engage unaffiliated businesses to assist us in providing you certain services. For example, we may hire a shipping company to help us deliver our services and products to you. We may also use third parties to process online transactions and credit card payments, provide advertising, marketing and promotional assistance, provide email services, or facilitate our online services (such as message boards, chat rooms, and surveys). In those instances, we may need to share your personal information with them. Third party service providers will only have access to the minimum amount of personally identifiable information necessary to carry out the specific service requested. Third party service providers will be contractually prevented from using the information they receive for any purpose, other than to carry out the specific service requested.

We sometimes offer promotions (like sweepstakes or free subscriptions) in conjunction with a third party sponsor. If you choose to participate in one of those promotions, we may share your information with the sponsor if they need it to send you a product or other special promotion they offer.

Links

Our Sites contain links to other websites. By clicking on any of these links, you acknowledge that these websites have their own privacy policies and that we are not responsible for the content of such links or their policies. Moreover these websites' privacy policies may differ from this privacy policy. We strongly encourage you to read the privacy policy of any website you may visit.

Third Party Advertising

Ads appearing on our Sites may be delivered to users by us or one of our advertising partners. Our advertising partners may set cookies. These cookies allow the ad server to recognize your computer each time they send you an online advertisement. In this way, ad servers may compile information about where you, or others who are using your computer, saw their advertisements and determine which ads are clicked on. This information allows an ad network to deliver targeted advertisements that they believe will be of most interest to you. This privacy statement covers the use of cookies by MOLI and does not cover the use of cookies by any advertisers.

Widgets and Other Applications

Third-party applications (such as widgets) created by third-party developers may also be available to users or visitors on the Site. These applications are small bits of software, often with interactivity, that can be installed into profiles or shared with other users. MOLI does not control the third-party developers, and cannot dictate their actions. When a user or visitor engages with a third-party application, that user or visitor is interacting with the third-party developer, not with MOLI. Users are therefore warned that any personal information that they post to these widgets is posted at the users??? own risk. MOLI accepts no liability for any disclosure by the widget developers of any personal information that you have provided to use the widgets. MOLI encourages users and visitors not to provide personally identifiable information to the third party???s application unless the users and visitors know the party with whom they are interacting.

Compliance with Law and Related Disclosure

There may be instances when MOLI may access or disclose personally identifiable information, profile information or non- personally identifiable information without providing you a choice in order to: (i) protect or defend the legal rights or property of MOLI, LLC and its affiliated companies, or their employees, agents and contractors (including enforcement of our agreements); (ii) protect the safety and security of MOLI users or visitors including acting in urgent circumstances; (iii) protect against fraud or for risk management purposes; or (iv) comply with the law or legal process. In addition, if MOLI, LLC or its affiliates sell all or part of their business or makes a sale or transfer of all or a material part of their assets or are otherwise involved in a merger or transfer of all or a material part of their business, they may transfer your personally identifiable information to the party or parties involved in the transaction as part of that transaction.

Children's Policy

MOLI does not knowingly collect or solicit personal information from anyone under the age of 18 or knowingly allow such persons to register directly on the Site. Unless you have been invited to register on the Site by another member who is over the age of 18, if you are under 18, please do not attempt to register for MOLI or send any information about yourself to us, including your name, address, telephone number, or email address. Unless you have been invited to register on the Site by another member who is over the age of 18, no one under age 18 may provide any personal information to or on MOLI. In the event that we learn that we have collected personal information from a child under age 18 without verification of parental consent, we will delete that information as quickly as possible. If you believe that we might have any information from or about a child under 18, please contact us at privacy@moli.com.

Our Sites may contain links to other websites, including websites directed to children. We have no control over the privacy practices or the content of any of our business partners, advertisers, sponsors or other websites to which we provide links from our websites. You should check the applicable privacy policy of the website sponsor when linking to other websites.

Choice/Opt-out

You have the opportunity to ???opt-out' of receiving certain communications from us, by indicating your choice on your account's ???E-mail Notifications??? preferences in the ???My Account??? section of your Control Panel. You may opt-out of receiving e-mail notifications for MOLI Updates (about MOLI news, new features, and events), New Alerts (tells you when a MOLI member comments on your profiles or posts), New Friends (tells you when a MOLI member adds you as a friend), and New MOLI Mail (tells you when a MOLI member sends you a message).

Protecting your privacy and your personally identifiable information is a top priority. We take commercially reasonable precautions to protect your personally identifiable information. We maintain physical, electronic, and procedurals safeguards in order to protect against the loss, misuse or alteration of your personally identifiable information.
