SQUARETRADE SIDEBAR PRIVACY POLICY AND TERMS OF USE
YOU MUST AGREE TO THE TERMS OF THIS PRIVACY POLICY AND THE TERMS OF USE BEFORE YOU INSTALL THE SQUARETRADE SIDEBAR.
The purpose of the SquareTrade SideBar ("SideBar") is to provide you with peace of mind when using the Internet by furthering your Trust in Transactions, by improving and enhancing your web browsing and online shopping experience. The SideBar will automatically alert you to potentially fraudulent or dangerous websites on the Internet. Over time, our services may be enhanced to offer additional features such as comparison shopping information. These services are offered free to you. You do not have to subscribe to all of these features and you will be offered the option to turn off any additional features by clicking on the "Preferences" tab within the Sidebar. You may uninstall the SideBar at any time if you no longer want the services it offers.
SQUARETRADE SIDEBAR PRIVACY POLICY
WHAT INFORMATION WE COLLECT
When you download the SideBar we do not collect any personally identifiable information (name, address, email address, phone number, credit card data, etc.) unless you provide it to us voluntarily. You may disclose your personally identifiable information to us when you email us, or when you sign up for specific services such as newsletters, the "tell a friend" option, surveys or email us for customer support.
SquareTrade does collect NON-personally identifiable information such as trend and pattern information about your web surfing and computer use. This information includes your zip code if you provide it; the URL addresses of the relevant Web pages you visit (including shopping websites and potentially dangerous or fraudulent websites); profiles and categories of products you view; and searches on the SquareTrade website. SquareTrade publishes the list of web sites it tracks and You can request this list by emailing sidebar@squaretrade.com. We also collect non-personally identifiable information about your computer such as your operating system and browser information.
HOW WE USE YOUR INFORMATION
We will not use any personally identifiable information you provide us unless you consent to such use. We will only share the personally identifiable information you provide with third parties providing services to SquareTrade that have agreed to maintain this information as we do (such as a survey consultant).
We use non-personally identifiable information to improve our services and to deliver comparison shopping information to you based upon your individualized use of the internet and the non-personally identifiable information we track. We may share aggregate trend or demographic information with third party advertising providers; search partners that use this information to provide us with search or other information that we ultimately provide to you; to conduct research; or in other limited circumstances when we are required to do so to protect our rights or when legally required to do so. This is aggregate information only and is not linked to any personally identifiable information you may have provided us.
HOW WE TRACK YOUR INFORMATION
We track your non-personally identifiable information in two ways; first by placing a randomly generated user identifier on your computer and second, by recording and storing your website usage.
In order to maintain your user experience we may also place cookies on your computer. A cookie is a text or data file stored on a computer's hard drive that can be used to identify the computer and contains information about the computer and your specified SideBar preferences. We use cookies to help us improve the user experience, analyze usage, improve our content and product offerings and to display relevant information to you based upon your computer usage. You may delete your cookies at any time, but if you delete your cookies, your SideBar preferences may be lost. SquareTrade will attempt to restore Your preferences by offering You a new cookie.
LINKS TO OTHER SITES
The SideBar may contain links to other websites. Please note that when you click on one of these links, you are "clicking" to another website. We encourage you to read the privacy statements of these linked sites as their privacy policy may differ from ours.
CHANGE IN OWNERSHIP
We do not sell or rent any information you provide. It is possible that we could merge with or be acquired by another business entity. Should such a combination occur, you should expect that we would share some or all of your information in order to continue to provide service. You will receive notice of such event (to the extent it occurs) and we will require that any new combined entity follow the practices disclosed in this Privacy Policy.
CHANGES TO THIS POLICY
If we make any material changes to this Privacy Policy, we will give you notice of these changes within the SideBar, and an opportunity to choose whether to have personally identifiable information treated under the terms of the revised policy. If you do not wish to accept the new terms, you may uninstall the SideBar. We will also continue to publish the current Privacy Policy on the SquareTrade website at http://www.squaretrade.com/safetysidebar for your reference.
SQUARETRADE SIDEBAR TERMS OF USE
THESE TERMS OF USE GOVERN THE USE OF THE SQUARETRADE SIDEBAR. SQUARETRADE MAY CHANGE THESE TERMS OF USE AND ITS PRIVACY POLICY FROM TIME TO TIME WITH NOTICE TO YOU. YOUR CONTINUED USE OF THE SIDEBAR, AFTER NOTICE WILL CONSTITUTE YOUR ACCEPTANCE OF THE CHANGE. ALTERNATIVELY YOU MAY UNINSTALL THE SIDEBAR IF YOU DO NOT AGREE WITH THE CHANGE.
BY DOWNLOADING THE SQUARETRADE SIDEBAR YOU ARE AGREEING THAT YOU HAVE READ AND UNDERSTOOD THE TERMS OF USE ("Terms") AND THE PRIVACY POLICY, AND THAT YOU WILL BE BOUND BY THEM.
SCOPE OF LICENSE
The SideBar, all software and third party data installed or utilized by the SideBar (collectively, the "SideBar") are owned by SquareTrade or SquareTrade's licensors, and are protected by copyrights, trademarks, service marks, international treaties, and/or other proprietary rights and laws of the U.S. and other countries. You are granted a personal, non-transferable, limited license to use the SideBar on a worldwide, non-exclusive, non-sublicenseable basis on the terms and conditions set forth below.
a. You may install and personally use the SideBar and any updates provided by SquareTrade (in its sole discretion) in object code form on a personal computer owned or controlled by you for your own noncommercial use or benefit. Your license to use the SideBar continues until one of us terminates it. You may terminate this license by uninstalling the SideBar using the Microsoft Windows Add/Remove Programs function. This license terminates automatically if you violate any term of this license.
b. YOU MAY NOT:
i. decompile, reverse engineer, disassemble, modify, sell, rent, lease, loan, distribute, or create derivative works (as defined by the U.S. Copyright Act) or improvements (as defined by U.S. patent law) from the SideBar or any portion thereof;
ii. incorporate the SideBar into any computer chip or the firmware of a computing device manufactured by or for you.
iii. use or export the SideBar in any unlawful manner, or for any unlawful purpose, including in violation of applicable U.S. laws or regulations, or in any manner inconsistent with these Terms.
UPDATES
Periodically the SideBar will contact the SquareTrade servers to see if your computer has the most current version of the software and will automatically provide you with the latest update to the SideBar. SquareTrade reserves the right to modify or terminate the SideBar from time to time, for any reason without notice and without liability to you.
PRIVACY
Our Privacy Policy is incorporated into these Terms and governs the use and collection of the information we collect from you. Please read it carefully.
DISCLAIMER OF WARRANTIES
YOU UNDERSTAND AND AGREE THAT THE SIDEBAR IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS, IMPLIED OR STATUTORY, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY OR NON-INFRINGEMENT.
SQUARETRADE DOES NOT ASSUME ANY LIABILITY FOR THE PROMPT, UNINTERRUPTED, OR ERROR FREE DELIVERY OF THE INFORMATION. WE ALSO MAKE NO WARRANTY OF ANY KIND REGARDING THE ACCURACY OR THE QUALITY OF WEB PAGES THAT MAY BE VIEWED BY LINKS FROM THE SIDEBAR. YOU WILL BE SOLELY LIABLE FOR ANY LOSS OF DATA THAT RESULTS FROM THE DOWNLOAD OF THE SIDEBAR OR FOR DAMAGE TO YOUR COMPUTER.
SQUARETRADE MAKES NO WARRANTY THAT THE SIDEBAR OR THE INFORMATION CONATINED THEREIN IS ACCURATE, TIMELY, RELIABLE, UNINTERRUPTED OR ERROR-FREE, OR THAT IT WILL MEET YOUR EXPECTATIONS.

LIMITATION OF LIABILITY
IN NO EVENT WILL SQUARETRADE OR SQUARETRADE'S LICENSORS BE LIABLE TO YOU FOR ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL OR EXEMPLARY DAMAGES, INCLUDING LEGAL FEES, ARSING OUT OF THE DOWNLOAD, USE, OR INABILITY TO USE THE SIDEBAR AND THE WEBLINKS CONTAINED THEREIN. IN NO EVENT WILL THE MAXIMUM LIABILITY OF SQUARETRADE EXCEED $100. Some jurisdictions do not allow limitation of incidental or consequential damages so this restriction may not apply to you.
INDEMNIFICATION
By accepting these Terms, You agree to indemnify and hold SquareTrade harmless from any claim or demand, including reasonable attorneys' fees, made by any third party in connection with or arising out of your use of the SideBar, your violation of any terms or conditions of these Terms of Use, your violation of applicable laws, or your violation of any rights of another person or entity.
GENERAL
The parties irrevocably agree that the laws of the State of California will govern these Terms of Use and our relationship, without reference to any choice of law rules. You agree to submit any dispute arising under these Terms of Use to mediation prior to filing an action against SquareTrade. All actions concerning these Terms of Use or the third party information provided or arising from them must be brought in the state or federal courts in the City and County of San Francisco, California. You may not assign this agreement, by operation of law or otherwise, without the prior written consent of SquareTrade. The failure of either party to enforce any of the provisions of these Terms of Use shall not be construed as a waiver of that provision or the right of the party to enforce that provision or any other provision. In the event that any provision these Terms of Use is found to be unenforceable or invalid the parties agree that that provision will be changed and interpreted so as to best accomplish the objectives of the provision within the limits of applicable law or applicable court decisions.
