Privacy Policy

PLEASE READ THIS PRIVACY POLICY CAREFULLY BEFORE USING THE BELOW-REFERENCED SITES.
This Privacy Policy along with our Terms of Use govern your interaction with the Site, and your registration for and use of the Site. Except as set forth within this Privacy Policy and our Terms of Use and other published guidelines, we do not release personally identifiable information about our users without their permission.
Introduction.
While you may use some of the functionality of the Site without registration, some of the specific tools and services might require registration. If you do not register with or use the tools, features or services offered on or through the Site, the only information we collect will be ???Non-Personal Information??? (i.e., information that is not traceable back to you and cannot be used to identify you). Non-Personal Information includes information such as the web pages that you have viewed through the use of ???Cookies??? (i.e., small data files that are stored on the hard drive of a computer used to view web sites that are accessible only by the party or site that placed the Cookie on the hard drive). If registration is required and you choose to register through the Site, we will require you to submit ???Personally Identifiable Information??? (i.e., information that can be traced back to you. Personally Identifiable Information includes information such as your name, home address, telephone number and email address). You are responsible for ensuring the accuracy of the Personally Identifiable Information you submit to Fliptrack. Inaccurate information will affect the information you receive when using the Site and tools and our ability to contact you. For example, your email address should be kept current because that is one of the primary manners in which we communicate with you.
California Privacy Rights.
Under California Law, California residents have the right to request in writing from businesses with whom they have an established business relationship, (a) a list of the categories of Personally Identifiable Information and the type of services provided to the customer, that a business has disclosed to third parties (including affiliates that are separate legal entities) during the immediately preceding calendar year for the third parties' direct marketing purposes, and (b) the names and addresses of all such third parties. To request the above information, please email us at: privacy@moblyng.com, or write to us at: Privacy, Fliptrack, Inc., 3705 Haven Ave Ste 111, Menlo Park, California 94025, with a reference to California Disclosure Information.
We will respond to such written requests within 30 days following receipt at the email or mailing address stated above. If we receive your request at a different email or mailing address, we will respond within a reasonable period of time, but not to exceed 90 days from the date received. Please note that we are only required to respond to each customer once per calendar year.
Consent.
BY SUBMITTING PERSONALLY IDENTIFIABLE INFORMATION TO US, AND/OR BY USING THE SITE, YOU AGREE THAT WE MAY COLLECT, USE AND DISCLOSE SUCH PERSONALLY IDENTIFIABLE INFORMATION IN ACCORDANCE WITH THIS PRIVACY POLICY AND TERMS OF USE, AND AS PERMITTED OR REQUIRED BY LAW.
If you do not agree with these terms, do not provide any Personally Identifiable Information to us. If you refuse or withdraw your consent, or if you choose not to provide us with any required Personally Identifiable Information, we may not be able to provide you with products or services that can be offered on the Site only if we have access to certain Personally Identifiable Information.
The Information We Gather.
Fliptrack gathers two types of information about users:
Non-Personal Information. When users come to the Site, we collect and aggregate Non-Personal Information indicating, among other things, which pages of the Site were visited, the order in which they were visited and which hyperlinks were ???clicked???. Collecting such information involves the logging of the IP addresses, operating system and browser software used by each user to the Site. Although such information is not Personally Identifiable Information, we can determine from an IP address a user???s Internet Service Provider and the geographic location of his or her point of connectivity.
We also use Cookies to help us determine the type of content and sites to which a user to the Site links, the length of time each user spends at any particular area of the Site and the specific functionality that users choose to use. Essentially, Cookies are a user???s identification card for the Fliptrack servers. Cookies are only read by the server that placed them, and are unable to execute any code or virus. Cookies allow Fliptrack to serve you better and more efficiently, and to personalize your experience at the Site. Cookies also may be used to facilitate a user???s log-in, but are not used to retain Personally Identifiable Information.
You should be able to control how and whether Cookies will be accepted by your web browser. Most browsers offer instructions on how to reset the browser to reject Cookies in the "Help" section of the toolbar. If you reject our Cookies, certain of the functions and conveniences of the Site may not work properly, but you do not have to accept our Cookies in order to productively use the Site.
Personally Identifiable Information. We collect Personally Identifiable Information that you provide to us when you register with us, rate or comment on a video, sign-up for newsletters and email messages, send us email messages and participate in the following features of the Site: message boards; blogs; polls and other forums. Among other things, we may use the Personally Identifiable Information that you provide to respond to your questions, provide you the specific services you select, send you the products that you order, send you newsletters about topics chosen by you, send you email messages about Site maintenance and updates, and inform you of significant changes to this Privacy Policy.
Registration. In order to use many of the features and functionality of the Site, we will require you to register with us. During the registration process, you will need to provide us with Personally Identifiable Information that may include, but may not be limited to, your name, age, gender, mailing address, email address and phone number. Fliptrack will rely on you to self-report accurate information, and will not take steps to verify any information that you provide.
Ratings and Comments. Fliptrack may offer you the ability to rate and comment on the videos, music and other content and materials available on the Site.
Forums. Fliptrack may offer various forums (collectively, the ???Forums???) at the Site that may include, but are not limited to: message boards; polls, blogs; and other forums. Depending on the type of Forum, you may be able to submit the following types of information and materials to Fliptrack: articles and other information.
Newsletters and Email to You. During registration and when you access your account information through the Site, you will be given the option of receiving recurring informational newsletters via email from Fliptrack. In order to subscribe to such newsletters via email, we need your contact information, such as name and email address. At the time you sign up for our email newsletters or any time thereafter, you can choose to opt-out of receiving additional newsletters from Fliptrack by sending an email message to OptOut@moblyng.comand stating in the body of the email message the name of the newsletter(s) that you no longer want to receive. You also can unsubscribe from a particular newsletter by simply clicking on the "unsubscribe" link at the bottom of any such email newsletter. An email to our automated unsubscribe service will be created on your computer. Click the "Send" button. You will then be unsubscribed from that newsletter within two to three business days.
Purchases. When purchasing products or services through the Site, users are required to provide Fliptrack with Personally Identifiable Information. Fliptrack uses this Personally Identifiable Information to process the order, send the product and/or provide the service.
Participation In Contests, Sweepstakes and Other Promotions. From time to time, Fliptrack may offer you the opportunity to participate in a contest, sweepstakes or other promotion through the Site. If you desire to participate in any such contest, sweepstakes or other promotion, you will be asked to provide us with certain information necessary to conduct such contest, sweepstakes or other promotion. This information may include, among other things, your name, age, mailing address, email address and phone number.
Communications with Fliptrack. Fliptrack may receive Personally Identifiable Information when you send an email message to or otherwise contact Fliptrack.
How We Use (and Do Not Use) the Information We Gather.
Please take some time to familiarize yourself with the different ways Fliptrack uses the information that we gather.
Non-Personal Information.
Fliptrack uses Non-Personal Information in aggregate form to build higher quality, more useful services by performing statistical analyses of the collective characteristics and behavior of our users, and by measuring demographics and interests regarding specific areas of the Site.
Personally Identifiable Information.
This Privacy Policy serves as notice that Fliptrack collects Personally Identifiable Information in the manners described herein. Except as set forth in this Privacy Policy or as specifically agreed to by you, Fliptrack will not disclose any Personally Identifiable Information we gather from you on the Site. Fliptrack will release Personally Identifiable Information to third parties: (a) to comply with valid legal requirements such as a law, regulation, search warrant, subpoena or court order; or (b) in special cases, such as a physical threat to you or others. In the event that we are legally compelled to disclose your Personally Identifiable Information to a third party, we will attempt to notify you unless doing so would violate the law or court order. We cooperate with law enforcement agencies in identifying those who may be using our servers or services for illegal activities. We also reserve the right to report any suspected illegal activity to law enforcement individuals or entities for investigation or prosecution. In addition to the other uses set forth in this Privacy Policy, we may disclose and otherwise use Personally Identifiable Information as described below.
Registration.
Fliptrack may use the Personally Identifiable Information that we collect from you during registration to contact you in connection with your use of the Site and to track who uses the various features and functionality offered at the Site. Additionally, we may use this information in determining the types of features, functionality, products and services to offer through the Site or otherwise.
Ratings and Comments.
Fliptrack may analyze and use the information received from your rating and comments in connection with the research conducted by or on behalf of Fliptrack and/or its partners and/or sponsors. Additionally, Fliptrack may publish on the Site and/or in other publications this information. Fliptrack may publish your DisplayName when publishing this information.
Forums.
Fliptrack may analyze and use the information received from your use of the Forums in connection with the research conducted by or on behalf of Fliptrack and/or its partners and/or sponsors. Additionally, Fliptrack may publish the information received from your use of the Forums either on the Site and/or in other publications.
Newsletters and Email to You.
Fliptrack uses contact information collected during registration to send you the newsletters and email messages that you request us to send you.
Purchases.
Fliptrack uses this Personally Identifiable Information collected during the purchasing process to fulfill the order, send the product and/or provide the service.
Participation In Contests, Sweepstakes and Other Promotions.
Fliptrack uses the Personally Identifiable Information that we collect from you when you participate in a contest, sweepstakes or other promotion through the Site for processing purposes. This Personally Identifiable Information will not be re-used, sold or shared in any manner by Fliptrack or any third parties unless you elect to receive additional information and promotional material from Fliptrack and/or third parties. If a third party administers the contest, sweepstakes or other promotion, your participation may be subject to that third party's terms and conditions, and privacy policy. Communications with Fliptrack.
When you send an email message to or otherwise contact Fliptrack, Fliptrack may use the information provided by you to respond to your communication and/or as described in this Privacy Policy. Also, Fliptrack may archive this information.
Disclosure to Fliptrack Operations and Maintenance Contractors.
Fliptrack operations and maintenance contractors sometimes have limited access to your Personally Identifiable Information in the course of providing products or services to Fliptrack. These contractors include vendors and suppliers that provide us with technology, services, and/or content related to better operation and maintenance of the Site. Unless you have opted-out of receiving emails and newsletters from Fliptrack, these contractors also may have access to your email address to send newsletters to you on our behalf. Access to your Personally Identifiable Information by these contractors is limited to the information reasonably necessary for the contractor to perform its limited function for Fliptrack. We also contractually require that our operations and maintenance contractors not use or disclose your Personally Identifiable Information for any purpose other than providing us with products and services.
Purchase or Sale of Business.
From time to time, we may purchase a business or sell one or more of our businesses and your Personally Identifiable Information may be transferred as a part of the purchase or sale. In the event that we purchase a business, the Personally Identifiable Information received with that business would be treated in accordance with this Privacy Policy, if it is practicable and permissible to do so. In the event that we sell a business, we will include provisions in the selling contract requiring the purchaser to treat your personally identifiable information in the same manner required by this Privacy Policy (including any amendments to this Privacy Policy). Government Authorities, Legal Rights and Actions.
Fliptrack may share your Personally Identifiable Information with various government authorities in response to subpoenas, court orders, or other legal process; to establish or exercise our legal rights; to defend against legal claims; or as otherwise required by law. In such cases we reserve the right to raise or waive any legal objection or right available to us. We also may share your Personally Identifiable Information when we believe it is appropriate to investigate, prevent, or take action regarding illegal or suspected illegal activities; to protect and defend the rights, property, or safety of the Site, our users, customers, or others; and in connection with our Terms of Use and other agreements.
Childrens??? Privacy.
Fliptrack strongly believes in protecting the privacy of children. In line with this belief, we do not knowingly collect or maintain Personally Identifiable Information on the Site from persons under 13 years of age, and no part of our Site is directed to persons under 13 years of age. If you are under 13 years of age, then please do not use or access the Site at any time or in any manner. Fliptrack will take appropriate steps to delete any Personally Identifiable Information of persons less than 13 years of age that has been collected on the Site without verified parental consent upon learning of the existence of such Personally Identifiable Information.
Linked Sites.
For your convenience there are links to web sites operated by companies other than Fliptrack (???Third Party Sites???) that we believe may be of interest to you. Fliptrack does not disclose your Personally Identifiable Information to these Third Party Sites without obtaining your consent. Fliptrack does not endorse and is not responsible for the privacy practices of these Third Party Sites. If you choose o link to one of these Third Party Sites, you should review the privacy policy posted on this other web site to understand how that Third Party Site collects and uses your Personally Identifiable Information.
Fliptrack Security Procedures.
The security and confidentiality of your information is extremely important to us. We have implemented technical, administrative, and physical security measures to protect your information from unauthorized access and improper use. From time to time, we review our security procedures in order to consider appropriate new technology and methods. Despite Fliptrack's efforts to protect your Personally Identifiable Information, there is always some risk that an unauthorized third party may find a way around our security systems or that transmissions of your information over the Internet will be intercepted. The following are some of the security procedures that Fliptrack uses to protect your privacy:
Fliptrack requires both a personal username and a password in order for users to access their Personally Identifiable Information.
Fliptrack uses firewalls to protect information held on our servers.
Fliptrack utilizes Secure Socket Layer (SSL) encryption in transmitting Personally Identifiable Information to our servers. In order to take advantage of encryption technology, you must have an Internet browser which supports 128-bit encryption.
Fliptrack closely monitors the limited number of Fliptrack employees who have potential access to your Personally Identifiable Information.
Fliptrack requires all Fliptrack employees to abide by our Privacy Policy and be subject to disciplinary action if they violate it.
Fliptrack backs-up our systems to protect the integrity of your Personally Identifiable Information.

The Site is hosted in the United States and is intended for and directed to users in the United States. Deleting Your Personally Identifiable Information.
If you want to (a) delete your Personally Identifiable Information from our systems, (b) update the Personally Identifiable Information that you have provided to us, or (c) change your preferences with respect to contacts or other activities, you can email us at privacy@moblyng.com. We try to promptly answer every email, but may not always be able to do so. Keep in mind, however, that there will be residual information that will remain within Fliptrack databases, access logs and other records, which may or may not contain such personally identifiable information. Fliptrack reserves the right, from time to time, to recontact former users of the Site.
